If you're a biological woman married to a biological man and become pregnant, your husband is presumed by Oklahoma law to be the child's father. And if you're considering divorce when you find out that you're pregnant? That complicates matters, even if you're living apart and your new partner or someone else is the father of your child.

If you and the other parent weren't married, Oklahoma child paternity laws may or may not seem like good news for you, depending on your specific situation. 

  1. Fathers must have their paternity proven in some way before they can have their parental rights established. This could mean they signed the birth certificate, they took a DNA test, or they are court-ordered to take a DNA test. 
  2. After paternity is established, they can petition the court for visitation and/or custody.
  3. Until paternity is proven, a mother cannot obtain child support, but the alleged father (again) has no visitation rights to the child.
